HITCUBES.COM TERMS & CONDITIONS
Responsibility (Customers & Product Owners)
We would
like to state that all responsibilities for the products advertised on our
web are totally under the owner responsibility. Payment made is directly
credited into owner account. The process of buying/selling is totally
between customer and the products owner. Therefore products owner need to
ensure that the product will be sent to your customers after the payment
made by the customers. The customers may also report to us if the products
owner failed to send the product after payment have been made. Hitcubes.com
will help to ensure all the transactions process smoothly and honestly
done. Hitcubes.com will not pay any amount for any loses during the
transaction process between customers and the product owners. The product
owners need to set the shipping fees and provided the information to the
customers.
Content License
When you give us
content, you grant us a non-exclusive, worldwide, perpetual, irrevocable,
royalty-free, sublicensable (through multiple tiers) right to exercise the
copyright, publicity, and database rights (but no other rights) you have in
the content, in any media known now or in the future.
Fees and Services
Joining hitcubes.com
and bidding on listed items is free. We do charge fees for using other
services, such as listing items. When you list an item or use a service
that has a fee you have an opportunity to review and accept the fees that
you will be charged based on our
Fees schedule, which we may change from time to time. Changes to that
Policy are effective after we provide you with at least fourteen days'
notice by posting the changes on the Sites. We may choose to temporarily
change the fees for our services for promotional events (for example, free
listing days) or new services, and such changes are effective when we post
the temporary promotional event or new service on the Sites.
Unless otherwise stated, all fees are quoted
in Ringgit Malaysia. You are responsible for paying all fees and applicable
taxes associated with the Sites in a timely manner with a valid payment
method. If your payment method fails or your account is past due, we may
collect fees owed using other collection mechanisms. (This includes
charging other payment methods on file with us, retaining collection
agencies and legal counsel, and for accounts over 180 days past due,
deducting the amount owed from your e-wallet account balance.)
Privacy
We do not sell or
rent your personal information to third parties for their marketing
purposes without your explicit consent. We use your information only as
described in the
hitcubes.com Privacy Policy. We view protection of users' privacy as a
very important community principle. We store and process your information
on computers located in the United States that are protected by physical as
well as technological security devices. You can access and modify the
information you provide us and choose not to receive certain communications
by signing-in to your account. We use third parties to verify and certify
our privacy principles. For a complete description of how we use and
protect your personal information, see the
hitcubes.com Privacy Policy. If you object to your Information being
transferred or used in this way please do not use our services.
Indemnity
You will indemnify
and hold us (and our officers, directors, agents, subsidiaries, joint
ventures and employees), harmless from any claim or demand, including
reasonable attorneys' fees, made by any third party due to or arising out
of your breach of this Agreement, or your violation of any law or the
rights of a third party.
No Agency
No agency,
partnership, joint venture, employee-employer or franchiser-franchisee
relationship is intended or created by this Agreement.
Notices
Except as explicitly
stated otherwise, legal notices shall be served on hitcubes.com's national
registered agent (in the case of hitcubes.com) or to the email address you
provide to hitcubes.com during the registration process (in your case).
Notice shall be deemed given 24 hours after email is sent, unless the
sending party is notified that the email address is invalid. Alternatively,
we may give you legal notice by mail to the address provided during the
registration process. In such case, notice shall be deemed given three days
after the date of mailing.
To help
protect our members, hitcubes.com has guidelines and policies describing
items that cannot be listed on hitcubes.com and might expose you to risk.

Any item that violates hitcubes.com policies
or infringes on the copyrights of others may be removed. In addition, some
listings are removed because the language or photos used in the item title
or description violate hitcubes.com policy. This means that some items you
may have purchased in a store, or even possibly on hitcubes.com, may not be
allowed or could be removed due to listing policies.
Receiving a notice of listing removal
– If you received a notice from hitcubes.com regarding a listing removal,
please read it carefully. It contains links to helpful information about
the applicable policies.
The VeRo Program – hitcubes.com
established the VeRO (Verified Rights Owners) Program to enable rights
owners to easily report and request removal of listings offering items or
containing materials that infringe their intellectual property rights.

Relisting prohibited or restricted Items
– While there may be similar listings that have been or are currently
listed on hitcubes.com, this does not mean that they’re acceptable. If you
feel that your item should not have been removed, you should not re-list
it. Instead please contact hitcubes.com by using the Prohibited or
Restricted item link in the “If you disagree with the ending of your
listing” section of this page. Continuing to list an item that has been
removed could result in suspension from hitcubes.com. You could also be
subject to legal action in some cases.
Receiving hitcubes.com fee refunds –
All fees related to the listing should be automatically credited to your
account within one billing cycle. If the fees are not credited to your
account after this time, please
contact us.
Note: hitcubes.com fees on listings
cancelled due to a policy violation may or may not be refunded,
depending on the policy violated and/or the seller’s prior (non)-compliance
with hitcubes.com policies.
Reporting a listing – If you see a
listing that you feel may be prohibited by hitcubes.com,
contact us . hitcubes.com will investigate it. However, due to privacy
concerns we will not be able to tell you about any actions we may take. The
actions taken on an account are confidential and between hitcubes.com and
the seller.
If you disagree with the ending of your
listing:
You can
contact hitcubes.com by selecting the reason your listing was removed.

If hitcubes.com agrees that your item was
removed in error, you will be allowed to relist it.

Credit/Debit Card Payment Provided By
Hitcubes.com
Credit/Debit card payment
will be offered to all members who do not have their own credit/debit
payment system.
- Rate as stated below:
- Gold – 5.5% per transaction
- Silver – 6.5% per transaction
- VIP – 7.5% per transaction
- Free – RM20 (7USD/ 5Euro) per transaction
- (Payment will be credited into your
account within 15days to avoid fraud)
- Hitcubes.com might change the rate at
anytime (depends on current market situation)
Payment Additional Info:
If your customers pay the product via
hitcubes payment option (Credit/Debit card or Hitcubes Bank Account
or Hitcubes E Wallet and others which are not directly to your
account), service charge will be charged for the products.
- Gold Member : 5.5%
- Silver Member: 6.5%
- VIP Member: 7.5%
- Free Member: RM20 (7USD/ 5Euro)
Therefore we advised the product owner to
set the price higher in order to cover the service charges if your
customers do not make the payment directly to your account.
Redeem
Point or Withdraw Hitcubes E Wallet
can be done if your account balance
achieved RM20/10USD
Hitcubes E Wallet Balance/Points will be
forfeited if no activities in member's account within 1 year
If member
passed away, their family can inherited the account or claimed the balance
amount of the account in Hitcubes E Wallet if they can provide us the true
death certificate and Hitcubes Account Statement details of that account
